These Terms and Conditions govern access to and use of the HR.makeupshop.ro platform, including candidate account creation and management, job applications, form submission, tests and assessments, interviews, and communications with Makeup Shop through this platform.

By accessing or using HR.makeupshop.ro, you confirm that you have read, understood, and accepted these Terms and Conditions. If you do not agree with them, do not use the platform.

1. Platform operator

The HR.makeupshop.ro platform is operated by S.C. MAKEUP SHOP S.R.L., with its registered office at Strada Mihail Kogălniceanu nr. 2, Sat Miroslava, Comuna Miroslava, Iași County, Romania, postal code 707305, registered with the Trade Register under no. J22/886/2010, tax identification code RO27079589, hereinafter referred to as “Makeup Shop”, “we”, “us”, or the “Company”.

2. Purpose of the platform

HR.makeupshop.ro is a recruitment and evaluation platform used to publish career opportunities, collect applications, manage selection stages, and document recruitment processes for roles available within Makeup Shop and, where applicable, its related brands, projects, and affiliated entities.

The platform is intended solely for professional and recruitment-related use. Its use does not automatically create an employment relationship, contractual relationship, or guarantee hiring or continuation in the recruitment process.

3. Eligibility

You may use the platform only if you have the legal capacity to provide the requested information and participate in a recruitment process. If you apply for a role that requires specific legal conditions regarding age, authorisation, or qualification, you are responsible for meeting those conditions.

If applicable law imposes age restrictions for a specific role or for the provision of certain data, the platform may only be used under the conditions permitted by law.

4. Candidate account

Some features may require you to create an account. You are responsible for:

• providing true, complete, and up-to-date information;
• keeping your login credentials confidential;
• all activity carried out through your account, to the extent permitted by law;
• updating your information when it changes.

You may not create fake accounts, use another person’s identity, allow another person to use your account, or attempt to bypass the platform’s technical or security measures.

5. Job applications and recruitment process

Through the platform, you may apply for one or more jobs published by Makeup Shop. An application may include forms, CV submission, supporting documents, additional questions, tests, assessments, interviews, or other selection stages, depending on the role.

The recruitment process may be structured in multiple stages. Completing one stage does not automatically guarantee access to the next stage. The decision to continue, pause, reset, or close an application belongs to Makeup Shop.

Makeup Shop reserves the right to modify, suspend, withdraw, or close any published role, and to change the structure of the recruitment process, without any obligation to continue the selection process through to hiring.

6. Tests, assessments, and interviews

Depending on the role, the platform may include tests, questionnaires, behavioural assessments, skills assessments, video interviews, audio interviews, or other selection tools.

By participating in these stages, you agree that:

• you must answer personally, honestly, and without impersonation;
• you will not copy, distribute, record, publish, transmit, or reuse the content of tests, questions, or interviews without our written consent;
• you will not use fraudulent methods, unauthorised automation, multiple accounts, prohibited external assistance, or any other means of manipulating results;
• some stages may be time-limited and subject to specific technical rules and validation requirements;
• some sessions may include audio recording, video recording, transcripts, or technically assisted analysis where such functionality is enabled and legally permitted.

If we identify reasonable indications of fraud, abusive behaviour, or breach of assessment rules, we may invalidate results, suspend the application, block access to the platform, or take other reasonable measures to protect the integrity of the recruitment process.

7. Candidate obligations

By using the platform, you represent and warrant that:

• the information you provide is, to the best of your knowledge, true, accurate, and complete;
• the documents you upload belong to you or you have the legal right to submit them;
• you will not submit unlawful, false, defamatory, discriminatory, obscene, abusive, or rights-infringing content;
• you will not attempt to test, scan, compromise, or interfere with the platform’s security, availability, or operation;
• you will not use the platform for any purpose other than legitimate recruitment-related purposes.

8. Intellectual property

The platform content, including without limitation its design, structure, texts, databases, interfaces, process logic, graphic elements, assessment materials, questions, forms, software, code, trademarks, trade names, and other materials, belongs to Makeup Shop and/or its licensors and is protected by applicable law.

You may not copy, reproduce, distribute, modify, decompile, extract, publish, sell, sublicense, or otherwise use the platform content except as strictly necessary to participate legitimately in the recruitment process.

9. Candidate-submitted content

You retain rights in the documents and materials you submit, to the extent those rights belong to you. By submitting them through the platform, you grant us a limited, non-exclusive, royalty-free right to use, store, review, internally copy, organise, and process them for recruitment, candidate evaluation, compliance, internal audit, and defence of our rights, in accordance with applicable law and our policies.

10. Confidentiality and personal data

Personal data is processed in accordance with the Privacy Policy applicable to HR.makeupshop.ro. By using the platform, you confirm that you have read that policy.

To the extent the recruitment process involves internal information, non-public assessment materials, internal feedback, or confidential documents, you agree not to disclose, distribute, or use them outside the purpose for which they were made available to you.

11. Communications

By using the platform, you agree to receive communications relating to your account, applications, assessment stages, interviews, application status, and the functioning of the platform by email, in-platform notifications, or other communication channels indicated in your account or application.

You are responsible for ensuring that your contact details are accurate and for monitoring communications relevant to your application.

12. Platform availability

We make reasonable efforts to keep the platform functional and secure, but we do not guarantee that it will always be available, uninterrupted, error-free, or free of technical incompatibilities. Maintenance, updates, technical limitations, and outages beyond our control may occur.

Makeup Shop may modify the platform’s features, flows, design, content, or technical conditions at any time.

13. Suspension or termination of access

We may suspend, restrict, or terminate your access to the platform, in whole or in part, temporarily or permanently, including by deactivating your account or invalidating an application, where there are reasonable grounds, including:

• breach of these Terms and Conditions;
• fraud or reasonable suspicion of fraud;
• abusive or unauthorised use of the platform;
• submission of false or misleading information;
• security, compliance, or recruitment process integrity risks.

14. No guarantee of employment

Use of the platform, account creation, applying for a job, taking tests, attending interviews, or receiving scores or results does not constitute and does not guarantee:

• employment;
• receipt of a job offer;
• continuation in the recruitment process;
• any particular outcome or timeline for the selection process.

Recruitment decisions remain solely with Makeup Shop and may involve human review, operational criteria, business needs, role fit, additional checks, and other legitimate considerations.

15. Limitation of liability

To the fullest extent permitted by law, Makeup Shop shall not be liable for indirect, incidental, special, or consequential damages arising out of the use of or inability to use the platform, technical errors, temporary unavailability, data loss, technical incompatibilities, or actions of third parties.

Nothing in these Terms and Conditions excludes or limits liability that cannot lawfully be excluded or limited.

16. Changes to the terms

We may update these Terms and Conditions from time to time. The version published on the platform at the time of use is the version that applies. Continued use of the platform after publication of an updated version constitutes acceptance of the updated terms.

17. Governing law and jurisdiction

These Terms and Conditions are governed by Romanian law. Any dispute will first be attempted to be resolved amicably and, failing such resolution, by the competent courts in Romania in accordance with applicable legal rules.

This Policy applies to individuals who create an account, apply for jobs, complete forms, take tests or assessments, attend interviews, or otherwise communicate with us through this platform.

2. What types of data we may process

Depending on the role you apply for, how you use the platform, and which evaluation steps are enabled for that role, we may process the following categories of personal data:

• identification and contact data, such as first name, last name, email address, phone number, city, address, and similar details;
• professional data, such as your CV, work history, education, certifications, portfolio, skills, languages, and other information relevant to your application;
• candidate profile and application data, such as the jobs you applied for, uploaded documents, availability, submitted answers, application status, and platform interaction history;
• assessment data, such as test answers, scores, results, reviewer observations, feedback, summaries, or other outputs generated during the evaluation process;
• interview-related data, including scheduling details, notes, internal feedback and, where a specific recruitment step uses this functionality, audio/video recordings and transcripts;
• technical and usage data, such as IP address, browser, device type, session identifiers, security logs, actions performed in the platform, and access timestamps;
• optional data that you choose to provide or that is explicitly requested by an application form, such as a profile photo, date of birth, gender/sex, or similar information, where there is a legitimate purpose and lawful basis for doing so.

Please do not upload sensitive data that is not necessary for recruitment, such as health information, racial or ethnic origin, political opinions, religious beliefs, trade union membership, genetic or biometric data, or information concerning sex life or sexual orientation, unless we expressly request it and there is a clear legal basis for doing so.

3. Purposes of processing and legal bases

We may process your personal data for the following purposes:

• creating and managing your candidate account, authentication, and operation of the platform;
• managing your application and running the recruitment process;
• scheduling interviews, sending administrative communications, and managing our relationship with you in connection with the role you applied for;
• running tests, assessments, interviews, and generating related results;
• assessing the suitability of your application for the relevant role and documenting the recruitment process;
• platform security, fraud prevention, prevention of unauthorised access, troubleshooting, audit, and service continuity;
• complying with applicable legal obligations and handling complaints, requests, or disputes;
• retaining your data for future opportunities or talent pool purposes, where we have an appropriate legal basis, including your consent where required.

The legal bases we may rely on include, as applicable:

• taking steps at your request prior to entering into a contract and, where relevant, performance of a contract;
• compliance with a legal obligation;
• our legitimate interests in managing recruitment, assessing candidates, protecting the platform, and defending our rights, after assessing the balance between our interests and your rights;
• your consent, where this basis is required or chosen by us for a specific processing activity.

If certain data is necessary in order to process your application and you choose not to provide it, we may be unable to continue the recruitment process or provide certain platform features.

4. Sources of data

We primarily collect data directly from you. In some situations, we may also receive data from other sources, such as internal recruiters, professional referrals, recruitment partners, or other relevant sources permitted by law. If we receive your data from a source other than you, we will provide the information required by law where applicable.

5. Who we may share data with

Your personal data may be accessed or disclosed, where necessary, to:

• members of our team involved in recruitment, HR, management, or technical administration of the platform;
• service providers that help us operate the platform and related processes, such as hosting, email, security, IT maintenance, video/interview, assessment, or technical support providers;
• consultants, auditors, lawyers, or other professionals where necessary to protect our legitimate interests or for compliance purposes;
• public authorities, institutions, courts, or other competent bodies where we have a legal obligation or a legitimate request to do so.

We do not sell your personal data.

6. International transfers

Where possible, we aim to use providers and infrastructure located within the European Economic Area. If, in some cases, personal data is transferred outside the European Economic Area, we will use a transfer mechanism recognised by applicable law, such as an adequacy decision or standard contractual clauses, together with appropriate supplementary measures where necessary.

7. How long we keep data

We keep personal data only for as long as necessary for the purposes for which it was collected or in order to comply with legal obligations and our legitimate interests.

• Candidate account data is kept for as long as the account exists and for a reasonable period afterwards where necessary for backup, security, audit, and follow-up request handling.
• Application and assessment data is kept during the recruitment process and for a reasonable period after its completion for handling requests, complaints, internal audit, defence of rights, and process improvement.
• Data retained on the basis of consent for future opportunities is kept until consent is withdrawn or until the relevant period communicated for that purpose expires.
• Technical logs and security data are kept for as long as necessary for security, technical investigations, and service continuity.

If you are hired, certain recruitment data may be carried over into internal employment-related processes and retained in line with applicable legal obligations and policies governing the employment relationship.

8. Automated decision-making

The platform may generate scores, summaries, rankings, or AI-assisted feedback. However, final recruitment decisions are not made solely by automated means producing legal effects or similarly significant effects on you without human involvement, unless we expressly inform you otherwise and there is a lawful basis for doing so.

9. Data security

We implement reasonable technical and organisational measures to protect personal data against unauthorised access, misuse, loss, destruction, or unlawful disclosure. That said, no IT system offers absolute guarantees, and using any online platform comes with some inherent level of risk.

10. Your rights

Subject to the conditions provided by law, you have the following rights:

• the right to be informed;
• the right of access;
• the right to rectification;
• the right to erasure;
• the right to restriction of processing;
• the right to data portability, where applicable;
• the right to object;
• the right not to be subject to a decision based solely on automated processing, including profiling, subject to legal conditions;
• the right to withdraw consent at any time where processing is based on consent.

If analytics tools or other non-essential technologies are used, they will be handled separately through the relevant consent mechanism and/or cookie policy.
